Terms of service

The agreement between you and fivedaylaunch.com. Plain English. Read it.

1. What we deliver

fivedaylaunch.com is an AI-built website service. When you sign up and pay, we:

• Build a working website using a template you select or an AI-driven design.
• Host it for the duration of your subscription (or for one year on the $499 one-time plan).
• Allow you to edit text, contact information, and menu labels via our content editor.
• Provide three free revision rounds per site for design adjustments.
• Ship the full source code at month 13 for subscribers, or at delivery for the Founder one-time plan.

2. Pricing and billing

• Pricing on the pricing page is the current price. You'll be told the exact amount before you confirm payment.
• Monthly subscriptions are billed in advance every 30 days from the date you approve your site.
• Annual subscriptions are billed once and renew annually.
• The Founder plan is a one-time charge with no recurring billing.
• You can cancel any time. See section 6.

3. Free trial sites

You can build a trial site at no cost. The trial site shows a preview using your business name and chosen template. Nothing is charged until you click "Approve and publish." Trial sites that are not approved within 14 days may be deleted.

You can have a maximum of three trial sites at any one time. Active in-progress sites must be approved or abandoned before starting a fourth.

4. Your content

You retain all rights to:

• Your business name, services, photos, logo, and any text you upload or type.
• The final delivered source code of your website (yours at month 13 for subscribers, or immediately for Founder plan).

You grant us a limited license to use this content for the purpose of building and hosting your site. We do not own your content. We will not use it for any other purpose.

What you can't upload:

• Content you don't have rights to (other people's photos, copyrighted text, trademarked logos that aren't yours).
• Anything illegal in your jurisdiction.
• Hate speech, harassment, sexual content involving minors, or material that violates applicable laws.

We reserve the right to refuse service if uploaded content violates these rules. We will refund any payment made if we decline a project on these grounds.

5. AI-generated content

Site copy is drafted using AI (Anthropic's Claude). You can edit, regenerate, or replace any AI-drafted text via our content editor. You are responsible for verifying that the final published text accurately describes your business — if AI invented something you don't actually do, edit it before you publish.

We do not warrant that AI-generated text is fact-checked, SEO-optimal, or legally compliant for your industry. That responsibility is yours.

6. Cancellation

• You can cancel any subscription via your portal Billing page or by emailing hello@fivedaylaunch.com.
• Cancellations take effect at the end of the current billing period — you keep your site live until then.
• We don't pro-rate refunds for partial months.
• If you cancel before month 13, you do not receive the source code release. Subscribers who cancel after month 13 still receive the code if they had not already received it.
• The Founder one-time plan is non-refundable after we deliver the site.

7. Refunds

If the site we deliver does not match the template you picked or the inputs you provided, we'll either fix it at no cost or refund you. Email hello@fivedaylaunch.com within 30 days of approval.

We don't refund based on subjective design preferences after approval — use the three free revision rounds before approving.

8. Service availability

We aim for high uptime but we don't guarantee any specific level. If our hosting or build pipeline is down for more than 8 hours, contact us and we'll credit you for the disruption.

9. Limitation of liability

To the extent permitted by law, our total liability to you for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages, including but not limited to lost profits, lost revenue, or business interruption.

Nothing in these terms excludes our liability for gross negligence, willful misconduct, or anything else that cannot legally be excluded.

10. Indemnification

You agree to indemnify us against any third-party claim arising from content you provided to us that infringes copyright, trademark, or other rights. (In plain English: if you upload someone else's photo and they sue, that's on you.)

11. Termination

We may terminate or suspend your account for material breach of these terms (especially section 4 about content). We'll give you notice and a chance to fix the problem first, except in cases of clear legal violations.

12. Governing law

These terms are governed by the laws of the State of Texas, USA. Disputes will be resolved in the state or federal courts of Collin County, Texas.

13. Changes to these terms

We may update these terms. If we materially change them, we'll email you 30 days before the change takes effect. Continued use of the service after the change means you accept the new terms.
